Preliminary injunctions from three judges have blocked the program nationwide until the lawsuits are resolved. The Justice Department usually appeals in such cases, but hasn't yet. "Legal experts say the Biden administration’s best move at the moment might be to huddle with congressional allies and come up with a program more likely to pass muster," Gerstein and Bustillo report. "Otherwise, they say, there’s a danger of provoking court rulings that might undermine other programs aimed at remedying past discrimination."
Several legal experts told Politico the program would be overturned if a case reached the Supreme Court.
